The price is set in Turkish lira and includes value added tax. As products and services are delivered electronically, no delivery or shipping charge applies. The total price fixed at the time of the order is not affected by later price changes.

- Ready-made website templates: a 1 (one) year licence and optional installation support.

- Paid technical support: support packages whose scope is stated on the product page.
- Downloadable digital products: digital products for which a download link is e-mailed after payment.
Article 5 – General Provisions
- The Buyer confirms that it has read and is informed of the pre-contractual information on the main characteristics, price, payment method, performance conditions and right of withdrawal, and has given the necessary electronic confirmation.
- The Agreement is concluded when the Buyer completes the order by accepting the Pre-Contractual Information Form and this Agreement at checkout. Performance begins once a card payment is approved or, for bank transfers, once the amount is credited to the Seller’s account.
- Where a separate contract has been signed or a quotation accepted between the Seller and a Buyer who is not a Consumer, the terms of that contract or quotation take precedence.
Article 6 – Payment
- Card payment: Card payments are taken through the infrastructure of the licensed payment institution iyzico with 3D Secure authentication. Card details are processed directly by iyzico; the Seller neither sees nor stores them.
- Bank transfer (havale/EFT): Payment is made to the Seller’s bank account shown at checkout, quoting the order number in the description. The Buyer may upload the payment receipt through the Site. The order is confirmed once receipt of the funds in the Seller’s account is verified. If payment is not made within the period stated at checkout, the order may be cancelled.
- For card payments, instalments, card promotions and bank charges are subject to the practice of the card-issuing bank.
- Before initiating a chargeback, the Buyer may contact the Seller to resolve the issue; this does not limit the Buyer’s statutory rights.
Article 7 – Performance and Delivery
- Downloadable digital products and template files: Once payment is approved, a download link is sent to [[alici_eposta]] and, where applicable, made available in the customer account. For security, download links may be valid for a limited time and/or number of downloads; an expired link will be renewed at the Buyer’s request.
- Software licences and access rights: The licence key or access details are provided electronically once payment is approved.
- Services: Once payment is approved, the Seller contacts the Buyer to start the service. Performance may require the Buyer’s contribution, such as access to ad accounts, the website, domain or server, content and approvals. The Seller is not responsible for delays caused by delays in the Buyer’s contribution.
- Installation support: Template installation support is performed on the date agreed by the parties, in the hosting environment provided by the Buyer. The scope of installation support is described on the product page.
- The Seller performs the order within 30 days at the latest. If performance becomes impossible within that period, the Seller notifies the Buyer within 3 days of becoming aware of it and refunds all payments collected within 14 days of the notification at the latest.
Article 8 – Term Plans, Renewal and Termination
- Monthly plans: Monthly plans run in one-month periods from the start date of the service. Each new period is renewed upon payment of the fee for that period (or its collection through a recurring payment method the Buyer has expressly authorised). The Buyer may cancel the plan at any time before the next period begins, through the customer account or by notice to info@adtouchlabsturkiye.com; cancellation takes effect at the end of the current period and no penalty applies. The fee paid for the current period is not refunded, without prejudice to the right of withdrawal in Article 9 and to cases of non-performance attributable to the Seller.
- Prepaid 3, 6 and 12-month plans: These plans are fixed-term, end automatically at the end of the term and are not renewed without the Buyer’s express request. The Seller sends the Buyer a reminder before the term ends; renewal is made by placing a new order.
- Early termination of a term plan by a Consumer: A Consumer may end a prepaid plan before its term expires without giving any reason and without paying any penalty. In that case, the amount calculated at the monthly plan price applicable on the order date for the months in which the service was provided up to termination (a started month counting as a full month) is deducted from the total amount paid, and the balance is refunded. In other words, the Consumer only gives back the discount specific to the prepaid plan for the period used. If the calculated amount is zero or less, no refund is made, but no additional payment is requested from the Consumer.
- Cases attributable to the Seller: If the service cannot be provided for reasons attributable to the Seller, or the Seller terminates the Agreement without just cause, the full fee for the period not provided is refunded.
- Annual template licence: A website template licence is valid for 12 months from the date the licence is delivered and does not renew automatically. For licences not renewed at the end of the term, update and support rights end; the conditions for continued use of a site built under the licence are stated on the product page and in the licence terms.
- Price changes: Price changes applying to renewal periods are notified to the Buyer a reasonable time before the new period begins and do not affect a period already paid for.
- Termination by the Seller: If the Buyer breaches the Agreement, the licence terms or the law (e.g. use outside the licence scope, requesting services for unlawful content) and fails to remedy the breach within a reasonable time after notice, the Seller may terminate the Agreement. In that case the fee for the period not provided is refunded, without prejudice to the Seller’s proven damages.
- For Buyers who are not Consumers, the terms of any separately signed contract or accepted quotation apply; failing these, the principles in this article apply.
Article 9 – Right of Withdrawal
- A Consumer has the right to withdraw from the Agreement within 14 (fourteen) days without giving any reason and without paying any penalty. For service and digital content contracts, the withdrawal period starts on the day the Agreement is concluded.
- It is sufficient to send a clear statement of withdrawal within the withdrawal period by e-mail to info@adtouchlabsturkiye.com or in writing to Skyport Rezidans No:1 Ofis 151, Beylikdüzü / İstanbul. The Consumer may also use the withdrawal form annexed to the Regulation. Quoting the order number speeds up processing.
- The Seller refunds all payments received within 14 days at the latest of receiving the withdrawal notice, using the payment method used by the Consumer and without any cost or obligation to the Consumer.
9.1. Cases where the right of withdrawal does not apply
Under Article 15(1) of the Regulation, the right of withdrawal cannot be exercised for:
- Services performed instantly in electronic form or intangible goods delivered instantly to the Consumer (Art. 15(1)(ğ)): digital products for which a download link has been provided, template files delivered, licence keys issued and software licences whose access has been activated. For these products, the right of withdrawal ends when delivery is made with the Consumer’s approval.
- Services whose performance has begun with the Consumer’s approval before the end of the withdrawal period (Art. 15(1)(h)): Google Ads setup and management, SEO/GEO, installation support and technical support services. For these services, the right of withdrawal ends when performance begins with the Consumer’s approval.
- Goods prepared in line with the Consumer’s requests or personal needs (Art. 15(1)(b)): content and work specifically prepared or customised for the Consumer.
These exceptions apply only if the Consumer expressly approves at checkout that performance should begin immediately and acknowledges that the right of withdrawal will be lost. If the Consumer requests in writing that a service start after the withdrawal period has expired, the Consumer may exercise the right of withdrawal until performance of the service begins. Where an order contains several products or services, the exceptions are assessed separately for each item; for example, even if a template licence has been delivered, the right of withdrawal may still be exercised for installation support that has not yet begun.
The statement of approval obtained from the Consumer at checkout reads as follows:
I request that delivery of the digital content and performance of the services I have purchased begin immediately, before the 14-day withdrawal period expires. I understand and accept that, once the digital content is delivered to me or performance of the service begins, I will lose my right of withdrawal for the relevant products and services under Article 15(1)(ğ) and (h) of the Distance Contracts Regulation.
The absence of a right of withdrawal does not affect the Consumer’s rights under the Law in the event of defective performance.
Article 10 – Rights and Obligations of the Parties
- The Seller performs the products and services with due care in accordance with the Agreement, the characteristics stated on the product page and the law. If the digital content or service is defective, the Consumer may exercise the elective rights listed in Articles 11 and 15 of the Law (withdrawal from the contract, price reduction, free repair or re-performance, or replacement with a non-defective equivalent where possible).
- The Buyer confirms that the information given in the order is accurate and up to date, and agrees to provide the access, content and approvals required for performance in good time, to comply with the licence terms and to use the products and services for lawful purposes.
- Unless expressly agreed otherwise, the advertising budget on Google Ads and similar ad platforms is not included in the service fee and is paid by the Buyer directly to the relevant platform. Ad platforms’ policy, account suspension and pricing decisions are beyond the Seller’s control.
- For digital marketing and AI services, no particular ranking, traffic, conversion or sales result is guaranteed; the Seller’s obligation is to perform the service with professional care and in line with industry standards.
- The Buyer bears legal responsibility for the content and data it sends to the Seller. If the Buyer has the Seller process personal data as part of the service, the parties will enter into a data processing agreement compliant with the KVKK.
Article 11 – Invoice
An e-Archive invoice for the products and services purchased is issued through the Paraşüt platform and sent to the Buyer’s e-mail address [[alici_eposta]]. For corporate invoices, the Buyer must enter its legal name, tax office and tax number correctly; the Buyer is responsible for consequences arising from incorrect information. For Buyers registered for e-Invoice, the invoice is issued in the document type required by law.
Article 12 – Force Majeure
Neither party is liable for delay or failure to perform caused by events beyond its control, such as natural disasters, epidemics, war, terrorism, strikes, cyber attacks, infrastructure or power outages, general failures of third-party service providers and decisions of public authorities. If force majeure lasts longer than 30 days, either party may terminate the Agreement; in that case the fee for the unperformed part is refunded.
Article 13 – Personal Data
The Buyer’s personal data is processed for the purposes and on the legal bases described in the Privacy Notice (KVKK).
Article 14 – Evidence
In the event of a dispute, the Seller’s electronic records, order, payment and approval records and e-mail correspondence constitute evidence within the framework of the Code of Civil Procedure No. 6100. This does not remove the Consumer’s right to submit counter-evidence.
Article 15 – Complaints and Dispute Resolution
The Buyer may send requests and complaints to info@adtouchlabsturkiye.com, by phone to +90 850 303 10 81 or by post to Skyport Rezidans No:1 Ofis 151, Beylikdüzü / İstanbul. The Seller aims to respond to complaints as quickly as possible.
Within the monetary limits set each year by the Ministry of Trade, a Consumer may apply to the consumer arbitration committee where the goods or services were purchased or where the Consumer resides; for disputes exceeding those limits, to the consumer courts. Applications to consumer arbitration committees can also be made through e-Devlet. In cases provided by law, mediation is mandatory before filing a claim with the consumer courts. For disputes with Buyers who are not Consumers, the Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction, without prejudice to mandatory mediation rules.
Article 16 – Entry into Force
This Agreement was concluded and entered into force on [[siparis_tarihi]] upon the Buyer’s electronic approval at checkout. The Agreement and the Pre-Contractual Information Form are sent to the Buyer’s e-mail address on a durable medium together with the order confirmation and are kept accessible in the customer account. The language of the Agreement is Turkish.
