These Terms of Use set out the rules for using the adtouchlabsturkiye.com website (the “Site”) operated by ADTOUCH LABS TÜRKİYE BİLGİ TEKNOLOJİLERİ TİC. LTD. ŞTİ. (“AdTouch Labs” or the “Company”). By visiting or using the Site, you are deemed to accept these terms. If you do not accept them, please do not use the Site. Purchases are also governed by the Distance Sales Agreement, the Pre-Contractual Information Form and the Cancellation & Refund Policy, and the use of customer accounts by the Membership Agreement. The Turkish version of these terms is the legally binding version.

2. Use of the Site

You may use the Site only for lawful purposes and in accordance with these terms. The following are prohibited:

• attempting to gain unauthorised access to the Site, its servers or connected systems, or circumventing or testing security measures;
• uploading malware, viruses or code that disrupts the Site; carrying out denial-of-service (DoS) attacks or placing excessive load on the Site;
• copying, downloading or using Site content in bulk, or for training AI models, by means of bots, spiders, scrapers or similar automated tools without the Company’s written permission;
• completing forms on behalf of another person, with false information, or by unlawfully using third parties’ personal data;
• using the Site to send unsolicited commercial messages (spam), or for fraud or phishing;
• using software, templates or digital products on the Site outside the scope of their licence by reverse engineering, decompiling or circumventing licence controls.

If the Company detects use in breach of these terms, it reserves the right to restrict the person’s access to the Site and to take legal action.

3. Intellectual Property Rights

All intellectual and industrial property rights in the texts, images, videos, graphics, logos, interface designs, software, source code, databases, blog content and other materials on the Site, and in the names and logos “AdTouch Labs”, “AdTouch Legal”, “NeuroAds”, “StayPanel”, “Meditouch”, “BrainCommerce” and other product names, belong to the Company or its licensors under the Law on Intellectual and Artistic Works No. 5846 and the Industrial Property Law No. 6769.

You may view Site content only for your personal information and to evaluate a business relationship with the Company. Except for short and reasonable quotations with attribution, content may not be reproduced, distributed, modified, adapted or used commercially without the Company’s prior written permission. The use of software, templates and digital products purchased or downloaded free of charge is subject to the licence terms stated at the time of order or on the product page; only the right of use described in the licence is granted, not ownership.

4. Demos, Sample Outputs and Performance Indicators

Product screens, demo interfaces, sample analyses, sample outputs, case studies and performance indicators on the Site (e.g. campaign return, number of pages analysed, service level percentages) are for promotional and illustrative purposes. Actual results may vary depending on the customer’s data, industry, budget, market conditions and manner of use, and no particular result is guaranteed. Service level and performance commitments are binding only to the extent expressly set out in a contract signed with the customer.

5. Important Notice on AI Outputs

• Outputs generated by AI systems may contain errors, omissions or outdated information. They should not be the sole basis for a decision without review by a responsible person.
• Outputs of AdTouch Legal and other legal analysis tools are not legal opinions or legal services and do not replace the professional judgement of a lawyer.
• Meditouch and other healthcare tools do not provide medical diagnosis or treatment recommendations and do not replace the assessment of a physician. In an emergency, call 112.
• Recommendations from advertising and marketing tools depend on ad platform policies and market conditions; no particular sales or return is guaranteed.

6. Nature of Site Content

Blog posts and informational content on the Site are for general information only and do not constitute legal, financial, medical or other professional advice. Some of this content is prepared with the help of AI tools and reviewed editorially. The Company takes reasonable care to keep content accurate and up to date, but cannot guarantee that it will always be current given changes in legislation and technology. Prices, campaigns and product information may change without notice; the price and terms applying to an order are those stated in the pre-contractual information and contract at the time the order is confirmed.

7. Information You Send Us

You are responsible for ensuring that the information you submit through forms is accurate and up to date. You may submit another person’s personal data only if you have a lawful basis to do so. Please do not include special categories of personal data such as health data, or confidential trade secrets, in forms; where confidential information needs to be shared, this will be done under a confidentiality agreement between the parties.

8. Third-Party Links and Services

The Site may contain links to and integrations with third-party websites, platforms or services (e.g. payment page, social media, maps, video platforms). These are not under the Company’s control, and the Company gives no warranty as to their accuracy, security, availability or privacy practices. Use of third-party services is subject to the relevant party’s terms.

9. Service Availability

The Company makes reasonable efforts to keep the Site running without interruption or error; however, access may be interrupted due to maintenance, updates, security incidents, failures of infrastructure or service providers, or force majeure. The Company may change the content, design and functions of the Site, or remove it wholly or partly, at any time. Access and availability commitments for paid services are set out in the relevant contracts.

10. Limitation of Liability

To the extent permitted by applicable law, the Company is not liable for indirect damages, loss of profit, loss of data or loss of reputation arising from the use of, or inability to use, the parts of the Site provided free of charge. This limitation does not apply:

• to damage caused by the Company’s intent or gross negligence (Turkish Code of Obligations No. 6098, Art. 115);
• to damage to life or physical integrity;
• to consumer rights arising from the Consumer Protection Law No. 6502 and other mandatory legislation.

Liability in relation to paid products and services is governed by the relevant contract and mandatory legislation.

11. Personal Data and Cookies

Information on personal data processed while you use the Site is set out in our Privacy Notice (KVKK), Privacy Policy and Cookie Policy.

12. Changes

The Company may update these Terms of Use. The updated terms apply from the date they are published on this page. Changes do not automatically amend contracts concluded before the publication date.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of the Republic of Türkiye.

• Consumers: Under Law No. 6502, within the monetary limits set each year by the Ministry of Trade, you may apply to the consumer arbitration committee where you purchased the goods or services or where you reside; for disputes exceeding those limits, to the consumer courts. In cases provided by law, mediation is mandatory before filing a claim with the consumer courts.
• Merchants and other users: The Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction. Where mandatory mediation is provided by law, mediation is required before filing a claim.
